A judge in Des Moines, Iowa has dismissed the wrongful death lawsuit brought by the wife of late Slipknot bassist Paul Gray .
According to the Des Moines Register , Polk County District Judge Dennis Stovall ruled this week that the action brought by Brenna Gray against Dr. Daniel Baldi was invalid because the 2-year statute of limitations had run out by the time she filed it. Gray's widow initiated the suit in February 2014; her late husband passed away in May 2010.
Brenna Gray's attorney argued that the clock on the 2-year statute of limitations should not have begun until his client had reason to believe that the physician caused her late husband's death, and that became evident earlier this year during testimony in Baldi's involuntary manslaughter trials. Judge Stovall disagreed with that assessment and dismissed the action.
Daniel Baldi was acquitted in May of involuntary manslaughter charges in the deaths of Paul Gray and six others, all of whom died of drug overdoses while under his care. The physician still faces malpractice lawsuits in several cases, and possible sanctions from the Iowa Board of Medicine. He has not practiced medicine since 2012.
Paul Gray died on May 24, 2010 at the age of 38. In addition to Brenna, he is survived by their daughter October , who was born after his death.
